Naturalization is the only way to acquire a US citizenship for a person who was not born within US borders or to an American parent, and is generally available only to <a href=\"https:\/\/usa-immigration.lawyer\/en\/green-cards\/\">Green Card<\/a> holders. The main difference in the conditions for Green Card holders who wish to naturalize in the US, is between single foreign citizens and those married to Americans.\n<p>It is important to distinguish between Certificate of Naturalization \u2013 which is proof that an individual has become a US citizen through the naturalization process \u2013 and <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/n-600instr.pdf\">Certificate of Citizenship<\/a>, which is proof that an individual acquired their US citizenship from their parents. \u00a0For further information, please read the article below written by attorney Michael Decker, one of the founding partners at our law office, an expert in US immigration law<\/p>\n<p><iframe title=\"Can I move back to my home country after making my naturalization application?\" src=\"https:\/\/www.youtube.com\/embed\/C9duzEbENeU?list=PLBN-S3D4K5QLecopXyI0MA5X5GIe9fCXe\" width=\"1744\" height=\"655\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h4><strong>Why is it important to get a Certificate of Naturalization, if you already have a Green Card?<\/strong><\/h4>\n<p>Permanent residency in the United States (commonly known as a <strong>\u201c<a href=\"https:\/\/usa-immigration.lawyer\/en\/green-card-a-lawyer-specializing-in-united-states-immigration-answers-your-questions\/\">Green Card<\/a>\u201d<\/strong>), is a great way to start your life in the United States. However, our recommendation to any Green Card holder that meets the following conditions is to apply for a <a href=\"https:\/\/usa-immigration.lawyer\/en\/applying-for-us-citizenship\/\">Naturalization<\/a> certificate. Why apply for citizenship by naturalization when Green Card holders have a permanent resident status \u2013 can live and work in the US, and enjoy most of the same benefits as US citizen? For starters, having a Green Card \u00a0does not provide you with the same legal rights that you would have as an American citizen. A few examples of the differences are as follows:<\/p>\n<p>\u00a0<\/p>\n<ul>\n<li>Unlike US citizens, Green Card holders are not guaranteed protection from deportation.<\/li>\n<li>Green Card holders need to maintain their center of life in the US to keep their resident status in the US while US citizens can reside anywhere in the world.<\/li>\n<li>As a Green Card holder, it is harder to bring other family members to the United States. While a Green Card can be <a href=\"https:\/\/usa-immigration.lawyer\/en\/2023\/01\/17\/green-card-application-for-your-parent\/\">extended to parents<\/a> or <a href=\"https:\/\/usa-immigration.lawyer\/en\/green-card-application-for-your-parent\/\">siblings<\/a>, adult married offspring who were born outside the US will not be given the opportunity to receive a Green Card on this basis. US citizens do not face this restriction.<\/li>\n<li>Green Card holders are not issued US passports, which currently allows entry to over 180 countries \u2013 many of which are not open to those who have only an Israeli passport.<\/li>\n<li>Green Card holders have no voting rights, cannot run for political office or work for the federal government.<\/li>\n<li>Green Cards must be renewed every 10 years.<\/li>\n<li>\n<\/li><\/ul>\n<p>Hence, as a US citizen you will be entitled to full legal rights and protections under the American law \u2013 rights and protections you don\u2019t fully get as a Green Card holder. It is also important to note that a person who naturalized in the US does not lose their citizenship of the country of birth:\u00a0U.S. law does not mention dual nationality\u00a0or require a person to choose one citizenship or another, and a person may theoretically have even three (or more) citizenships.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2289 aligncenter\" src=\"https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" loading=\"lazy\" srcset=\"https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2-300x200.jpg 300w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2-1024x683.jpg 1024w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2-768x512.jpg 768w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2-1536x1024.jpg 1536w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2-24x16.jpg 24w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2-36x24.jpg 36w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2-48x32.jpg 48w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/washington-DC-2.jpg 1599w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<h4><strong>How to apply for a US citizenship as a Green Card holder?<\/strong><\/h4>\n<p>The form you are required to complete in order for the US Citizenship and Immigration Services (<strong>\u201cUSCIS\u201d<\/strong>) to examine your request is called <a href=\"https:\/\/www.uscis.gov\/n-400\">N-400, Application for Naturalization<\/a>. There is a filing fee of $640 for the form, and an $85 biometric fee (see additional information below). You may submit the form to the USCIS online or by mail, as early as 90 calendar days before you complete your residence requirements described in detail below.<\/p>\n<h4><strong>Is it possible to apply for a<\/strong><strong> Green Card<\/strong><strong> (and later, for naturalization),<\/strong><strong> on the basis of marriage?<\/strong><\/h4>\n<p>Foreign citizens who marry a U.S. citizen or a Green Card holder may obtain a Green Card on <a href=\"https:\/\/usa-immigration.lawyer\/en\/green-card-on-the-basis-of-marriage-or-engagement\/\">the basis of marriage<\/a>. This process is usually long and time-consuming, but significantly shorter in cases where the application is submitted by a spouse who is an American citizen, compared with cases where a spouse who is a Green Card holder submits the application. In case your spouse is an American citizen, you may apply for US citizenship already three years after receiving the Green Card, as described below.<\/p>\n<h4>What conditions must a Green Card holder meet in order to be eligible for naturalization in the US?<\/h4>\n<ul>\n<li>You must be at least 18 years old.<\/li>\n<li>If you are not married to a US citizen: It is important to apply to naturalize as a US citizen<a href=\"https:\/\/usa-immigration.lawyer\/en\/applying-for-us-citizenship\/\"> as soon as you are eligible<\/a> for it. A Green Card holder may submit their application for naturalization after five years of living in the United States. During this time period, it is highly recommended that you spend at least 50% of each calendar year in the US \u2013 otherwise the authorities might decide that your \u201clife center\u201d was not in the US. It\u2019s important to maintain residence until you have finished the process and received your Certificate of Naturalization.<\/li>\n<li>If you are married to a US citizen, and acquired your Green Card through marriage, you may apply for citizenship after just 3 years of marriage (your spouse must have been a US citizen since before your marriage). During these 3 years, you must not have been outside of the United States for a period longer than 18 months and again it is recommended to reside in the US for the majority of this time.<\/li>\n<li>You must have lived in the US state where you are applying for citizenship for the last 3 months prior to submitting the application.<\/li>\n<\/ul>\n<p><iframe title=\"How long does the process of US naturalization take?\" src=\"https:\/\/www.youtube.com\/embed\/qaAkJd-vC5Y?list=PLBN-S3D4K5QLecopXyI0MA5X5GIe9fCXe\" width=\"1744\" height=\"655\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<ul>\n<li>Criminal background and immigration history: Part of the naturalization process includes a thorough inspection of your immigrant history and any criminal background in the United States and <a href=\"https:\/\/lawoffice.org.il\/en\/israeli-police-criminal-record-abroad\/\">abroad<\/a>. Criminal background in the US means not only convictions in court but includes also arrests or charges brought against you (even if the charges were finally dropped). When the USCIS reviews your immigration history, they will look for things like\u00a0 working illegally (or even a suspicion of work without a visa), marriage fraud, crossing the US border illegally, or <a href=\"https:\/\/usa-immigration.lawyer\/en\/overstaying-your-us-visa\/\">overstaying your visa<\/a>. If you have any type of criminal background, it is very important to check this with a US immigration lawyer PRIOR to filing an N-400 application.<\/li>\n<li>You are able to read, write and speak at least basic English.<\/li>\n<li>You know the fundamentals of American history and the form of and principles of the US government. Both your level of English and knowledge of US history <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-e-chapter-2\">will be tested when you apply<\/a>.<\/li>\n<\/ul>\n<p>Exceptions to these conditions and additional information can be found in the <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/guides\/M-480.pdf\">Naturalization Eligibility Worksheet Instructions<\/a>, posted by the USICS.<\/p>\n<h4><strong>What happens after submitting your request?<\/strong><\/h4>\n<ul>\n<li><strong>Biometrics<\/strong> \u2013 unless your fingerprints were taken in a previous immigration application, you will need to provide your biometric data; the USCIS will send you an appointment notice, regarding the date, time and location where this data will be taken.<\/li>\n<li><strong>Interview and test<\/strong> \u2013 the (almost) final step before getting your naturalization certificate is an interview with a USCIS officer, who will ask you questions about your application and background.\u00a0You will also undergo an English and <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/questions-and-answers\/100q.pdf\">Civics<\/a><\/li>\n<li><strong>Taking the oath<\/strong> \u2013 once you have successfully completed all the mentioned steps, the USCIS will schedule you to take the <a href=\"https:\/\/www.uscis.gov\/citizenship\/learn-about-citizenship\/the-naturalization-interview-and-test\/naturalization-oath-of-allegiance-to-the-united-states-of-america\">Oath of Allegiance<\/a> at a naturalization ceremony. After taking the oath you will be considered a US citizen, and will receive your coveted Certificate of Naturalization.<\/li>\n<\/ul>\n<p><strong>Are Certificate of Naturalization and Certificate of Citizenship the same thing?<\/strong><\/p>\n<p><u>No. Although both certificates are legal proof of US citizenship, the Certificate of Naturalization is issued to foreign citizens who chose to voluntarily become US citizens through the naturalization process, while the\u00a0<a href=\"https:\/\/www.boundless.com\/immigration-resources\/certificate-of-citizenship\/\">Certificate of Citizenship<\/a> is issued to US citizens who\u00a0acquired their US citizenship through their parents.<br>\n<\/u><\/p>\n<p><strong>Which details appear on the Certificate of Naturalization ?<\/strong><\/p>\n<p>The certificate of Naturalization includes the following <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-k-chapter-3#footnote-3\"><strong>details<\/strong><\/a> of information regarding the\u00a0 foreign citizen who acquired their US citizenship through naturalization:<\/p>\n<ul>\n<li>Their USCIS\u00a0registration\u00a0number (A-number);<\/li>\n<li>Full name;<\/li>\n<li>Marital status ;<\/li>\n<li>Place of\u00a0residence;<\/li>\n<li>Country of\u00a0former\u00a0nationality;<\/li>\n<li>Photograph;<\/li>\n<li>Applicant\u2019s signature;<\/li>\n<li>Other descriptors: sex, date of birth and height.<strong><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-2295 size-medium\" src=\"https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/White-house-DC-300x164.jpg\" alt=\"Certificate of Naturalization\" width=\"300\" height=\"164\" loading=\"lazy\" srcset=\"https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/White-house-DC-300x164.jpg 300w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/White-house-DC-768x419.jpg 768w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/White-house-DC-24x13.jpg 24w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/White-house-DC-36x20.jpg 36w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/White-house-DC-48x26.jpg 48w, https:\/\/usa-immigration.lawyer\/en\/wp-content\/uploads\/2023\/03\/White-house-DC.jpg 1000w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/strong><\/li>\n<\/ul>\n<p>The certificate also contains other formal information, such as certificate number, date of issuance and a statement by the USCIS director \u2013 indicating that the applicant complied with all the eligibility requirements for naturalization under the laws of the United States.<\/p>\n<p><strong>How can a naturalized citizen obtain a US passport upon completion of their naturalization process?<\/strong><\/p>\n<p>It is likely that one of the first steps you will want to take as a new citizen of the United States is obtaining a US passport. In order to do so, you will need to feel in form DS-11 and provide evidence of US citizenship, which you may do with your Certificate of Naturalization.
